General Terms

Terms applying to every AP Racing service

These general provisions form the binding agreement between each purchaser or participant and Andy Potts Racing, LLC. They apply to memberships, coaching, training plans, camps, clinics, experiences and related services.

PART I — TERMS AND CONDITIONS

Website and program terms for AP Racing customers, members, athletes and camp participants

IMPORTANT RECURRING-BILLING DISCLOSURE

Squad and Crew renew annually on the member’s enrollment anniversary. PH+ renews every two months. Continuing 1:1 Coaching renews monthly after the initial three-month commitment. The amount, frequency, cancellation policy and minimum commitment must appear clearly beside the purchase button and again before payment authorization.

1. Agreement; AP Racing identity; how to cancel

These Terms and Conditions (the “Terms”) are a binding agreement between the purchaser or participant (“you,” “your,” “Athlete,” “Member” or “Participant”) and Andy Potts Racing, LLC, a Colorado limited liability company doing business as AP Racing (“AP Racing,” “we,” “us” or “our”). These Terms apply to AP Racing websites, memberships, coaching services, training plans, camps, clinics, experiences and related services (collectively, the “Services”).

Questions, notices and cancellation requests may be sent to andy@andypottsracing.com. AP Racing’s mailing address is [INSERT AP RACING MAILING ADDRESS]. Online subscriptions may also be canceled through [INSERT AND TEST ONE-STEP ONLINE CANCELLATION URL]. The online cancellation method must remain easy to find and use.

By purchasing, enrolling, applying, electronically checking an agreement box, signing a program agreement, accessing Services or participating in an AP Racing activity, you acknowledge that you have read, understood and agreed to the Terms, the applicable Program Schedule, the Cancellation and Refund Policy, the Privacy Policy, and the Participant Agreement and Release. If you do not agree, do not purchase or participate.

2. Eligibility and authority

You represent that you are at least eighteen years old and legally able to enter into this agreement. A participant under eighteen may participate only if AP Racing permits minor participation and a parent or legal guardian completes AP Racing’s separate minor consent, medical authorization and release documentation. Purchasing for another adult does not bind that person to the Participant Agreement; each adult participant must personally accept it.

3. Accounts and accurate information

You must provide current, complete and accurate contact, billing, health, emergency, training and program information. You are responsible for protecting account credentials and promptly notifying AP Racing of unauthorized access or changes that could affect safe participation. AP Racing may rely on information you provide when assigning coaches, preparing training, grouping participants, arranging travel or responding to an emergency.

4. Prices, taxes and payment authorization

Prices are shown in United States dollars unless the product or event listing states otherwise. Applicable taxes, processing charges and event-specific expenses will be disclosed before purchase when known. You authorize AP Racing and its payment processors to charge the selected payment method for the amount and schedule displayed at checkout, including any authorized installment or recurring payments.

AP Racing will not add a new fee or materially change a recurring price without providing the notice and obtaining any consent required by law. Failed payments may result in suspended access, delayed delivery, loss of a reserved camp space or termination after reasonable notice. You remain responsible for properly authorized amounts already due.

5. Automatic renewal and recurring payments

If you select a recurring product, the subscription will renew automatically at the price and interval disclosed at checkout until canceled. The renewal date is based on the original enrollment or subscription date, not a universal October 1 date.

Before enrollment, AP Racing will clearly disclose the recurring charge, renewal interval, cancellation policy, minimum purchase obligation and how to cancel. AP Racing will provide a retainable written acknowledgment after enrollment and renewal or material-change notices when required by applicable law. Canceling prevents future renewal charges; it does not ordinarily create a refund for an active or completed paid period.

6. Nature and limits of AP Racing services

AP Racing provides athletic education, coaching, community access, training plans and experiential services. Results are not guaranteed. Athletic performance depends on health, preparation, execution, recovery, environmental conditions, equipment, personal decisions and other factors outside AP Racing’s control.

AP Racing does not provide medical diagnosis, treatment, physical therapy, mental-health treatment, emergency services, legal advice or clinical nutrition unless a separately identified licensed professional is engaged under a separate agreement. Training recommendations are not a substitute for individualized medical advice.

7. Athlete and participant responsibilities

You are responsible for determining whether you can safely complete a workout or activity, using appropriate equipment and safety gear, following applicable laws and venue rules, monitoring weather and environmental conditions, stopping when symptoms or hazards arise, and seeking qualified medical care when appropriate.

You must promptly disclose material injuries, illnesses, medications, limitations or changes that could affect participation. AP Racing may modify, restrict or stop participation when it reasonably believes safety, conduct, readiness, incomplete information or program fit creates a concern.

8. Communication and response expectations

Use the communication channels designated for the selected program. Unless a Program Schedule states otherwise, coaches generally respond within two business days, excluding travel, camps, holidays, emergencies and planned time away. AP Racing does not provide continuous monitoring, emergency response or guaranteed same-day availability. If you experience an emergency, contact emergency services rather than an AP Racing coach.

9. Regional hubs, coaches and service partners

AP Racing may use employees, independent coaches, regional club partners, event partners, lodging providers, transportation providers, venues, technology platforms and other service providers to deliver Services. AP Racing retains the national customer relationship for AP Racing memberships and may share appropriate information with the coach, regional hub or partner serving you as described in the Privacy Policy.

A regional affiliation is optional unless a specific program says otherwise. Ending a regional partnership does not automatically end an active national Squad membership. Local availability, group composition, schedules and benefits are not guaranteed.

10. Conduct, community and removal

Participants must behave safely, lawfully, respectfully and consistently with AP Racing’s community standards. Harassment, discrimination, threats, dishonesty, dangerous conduct, abuse of staff or participants, unauthorized commercial solicitation, material sponsor conflicts, misuse of AP Racing intellectual property or conduct likely to harm the community may result in restricted access or removal.

AP Racing may suspend or terminate access for material breach, nonpayment, unsafe conduct or conduct that threatens participants, staff, partners or AP Racing’s reputation. Refund eligibility following termination is governed by the Cancellation and Refund Policy and applicable law.

11. Intellectual property and personal use

Training plans, workouts, educational materials, videos, graphics, program names, logos, photographs, written content and other AP Racing materials are owned by AP Racing or its licensors. Your purchase grants a limited, personal, nonexclusive, nontransferable right to use the materials for your own participation. You may not resell, distribute, publish, copy in bulk, sublicense or use the materials to coach others without written permission.

12. Third-party platforms and services

Services may depend on TrainingPeaks, Squarespace, payment processors, email providers, travel suppliers, regional partners and other third parties. Their terms and privacy practices may also apply. AP Racing is not responsible for outages, policy changes, data loss or failures caused solely by third-party systems outside AP Racing’s reasonable control, but this clause does not eliminate responsibilities that applicable law does not permit AP Racing to disclaim.

13. No guarantees; service changes

AP Racing may make reasonable changes to coaches, training content, schedules, communication channels, benefits, routes, venues, lodging, support levels or program operations. AP Racing will not materially reduce a paid service without a reasonable substitute, credit or refund when required by the applicable Program Schedule or law.

14. Disclaimer and limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SERVICES AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF A PARTICULAR PERFORMANCE RESULT, FITNESS OUTCOME, RACE RESULT, UNINTERRUPTED ACCESS OR ERROR-FREE DELIVERY.

TO THE FULLEST EXTENT PERMITTED BY LAW, AP RACING WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST RACE FEES, LOST TRAVEL COSTS, LOST INCOME, LOST OPPORTUNITY OR LOSS OF DATA, ARISING FROM THE SERVICES. EXCEPT FOR PERSONAL-INJURY CLAIMS GOVERNED BY THE PARTICIPANT AGREEMENT AND OBLIGATIONS THAT CANNOT LAWFULLY BE LIMITED, AP RACING’S AGGREGATE CONTRACTUAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold the Released Parties harmless from third-party claims, losses and reasonable costs arising from your unlawful conduct, intentional misconduct, material breach of these Terms, misuse of AP Racing materials, damage you cause to property, or injury you cause to another person. This obligation does not require you to indemnify a Released Party for liability that cannot lawfully be shifted to you.

16. Governing law; disputes

Colorado law governs these Terms without regard to conflict-of-law principles. Before filing a claim, the parties will make a good-faith effort to resolve the dispute through written notice and direct discussion. Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court of competent jurisdiction in Colorado. This draft does not impose mandatory arbitration or a class-action waiver; counsel may recommend additional dispute terms.

17. Changes, severability and entire agreement

AP Racing may update these Terms prospectively. Material changes to recurring billing, cancellation rights or a paid service will be communicated in a retainable form and will not take effect without any notice or consent required by law. If a provision is unenforceable, it will be narrowed or severed to the minimum extent necessary, and the remaining provisions will continue. These Terms, the selected Program Schedule, checkout disclosures, Privacy Policy, Cancellation and Refund Policy, Participant Agreement and any signed event addendum form the complete agreement for the Service.

PROGRAM SCHEDULE A

PH+ COACHING TERMS

This Schedule applies only to AP Racing PH+ Coaching and controls if it conflicts with the general Terms.

A1. Price and renewal

PH+ costs $299 every two months. The first two-month cycle begins on the enrollment date or another start date confirmed in writing. The subscription renews automatically every two months on the 1st of the month closest in date to the corresponding billing date until canceled. Minimum 6 month commitment and AP Racing has the right to collect payment via their payment system or invoice for any remaining payments if you cancel early.

A2. Included each two-month cycle

An updated two-month training block delivered through TrainingPeaks.

Coach review of progress, available information and upcoming needs.

One scheduled coaching consultation.

One reasonable round of planned adjustments following the consultation.

Limited questions through the designated communication channel.

General training and race guidance within the coach’s professional scope.

A3. Not included

Continuous workout monitoring or daily accountability.

Weekly plan rewriting, unlimited messages, on-demand calls or guaranteed immediate replies.

Multiple schedule changes within one cycle, full plan rebuilds or detailed race-execution plans unless purchased separately.

Medical diagnosis, treatment, rehabilitation or clinical nutrition.

A4. Delivery and athlete cooperation

The athlete must complete the requested intake, provide accurate TrainingPeaks access and supply necessary information. AP Racing generally builds the cycle within five business days after complete intake and payment. Late, missing or inaccurate information may delay delivery without extending the paid cycle unless AP Racing agrees otherwise.

PROGRAM SCHEDULE B

1:1 Coaching

Program Schedule B — 1:1 Coaching

This Schedule applies only to AP Racing 1:1 Coaching and controls if it conflicts with the general Terms.

B1. Price, initial commitment and renewal

1:1 Coaching costs $299-$1599 per month based on the athlete’s elected enrollment. Enrollment requires an initial six-month commitment, which may be collected as a single payment for any remaining balances if the athlete cancels prior to the initial six-month commitment ending. After the initial term, continuing coaching renews monthly at $299 on the enrollment anniversary date until canceled with thirty days’ written notice.

B2. Included

An assigned AP Racing coach and individualized TrainingPeaks plan.

Ongoing workout review, progress oversight and reasonable plan adaptation.

Regular coach communication through designated channels.

Race preparation, training-zone guidance, travel and schedule adjustments, and athlete accountability.

B3. Not included

Unlimited or emergency access, guaranteed same-day responses or constant live monitoring.

Medical treatment, physical therapy, clinical nutrition or mental-health care.

Camp, clinic, race-entry, equipment, laboratory testing or travel costs.

Extensive strength programming unless purchased as a separate add-on.

B4. Coach assignment and changes

AP Racing may assign or reassign a coach based on fit, capacity, travel, staffing or business needs. If AP Racing cannot provide a reasonable substitute or deliver material coaching services, the athlete may receive an appropriate credit or prorated refund as described in Part III.

Program Schedule C — Squad Membership

This Schedule applies only to AP Racing Squad Membership and controls if it conflicts with the general Terms.

PROGRAM SCHEDULE C

SQUAD MEMBERSHIP TERMS

This Schedule applies only to AP Racing Squad Membership and controls if it conflicts with the general Terms.

C1. Price and anniversary renewal

Squad Membership costs $199 for one year. Membership begins on the enrollment date and automatically renews for successive one-year terms on that enrollment anniversary or on the 1st or 15th of the month post enrollment date at the then-disclosed price until canceled. AP Racing will provide renewal notice and a cancellation method as required by applicable law.

C2. Included

Access to the national AP Racing athlete community and designated communication channels.

General coaching education, resources, virtual challenges and team communications.

Opportunities to connect through team races, local meetups, camps and other experiences when offered.

Member gear opportunities, announced gear credits and partner benefits subject to availability and partner terms.

C3. Not included or guaranteed

Individual coaching, a personalized training plan or workout monitoring.

Camp, clinic, race-entry, equipment, travel or lodging fees.

A local or regional hub in every location.

Sponsorship, compensation, free products or a guaranteed amount of partner savings.

C4. Regional affiliation and gear benefits

Regional affiliation is optional. Members may select an available regional hub, join a future-region interest list or choose no regional affiliation. Gear credits and discounts are promotional benefits, have no cash value, may be limited to stated purchase windows and vendors, do not carry over unless expressly stated, and may change when partner relationships change.

PROGRAM SCHEDULE D

CREW MEMBERSHIP TERMS

This Schedule applies only to AP Racing Crew Membership and controls if it conflicts with the general Terms.

D1. Eligibility, price and anniversary renewal

Crew is a selective membership. An athlete must apply, be accepted and remain in good standing. Crew Membership costs $199 for one year, begins on the enrollment date and automatically renews for successive one-year terms on that enrollment anniversary or the 1st or 15th of the month post enrollment at the then-disclosed price until canceled or AP Racing gives notice that Crew eligibility will not be renewed. AP Racing will provide renewal notice and a cancellation method as required by applicable law.

D2. Included

Active Squad membership benefits during the Crew term.

Crew designation and access to designated Crew communications.

Orientation, ambassador resources and Crew-specific activations when available.

Eligibility for Crew-only opportunities, without any guarantee that a particular opportunity will be offered.

D3. No employment, compensation or sponsorship guarantee

Crew membership does not create employment, agency, partnership or authority to bind AP Racing. It does not guarantee payment, sponsorship, free product, travel, lodging, race entry, event access, media exposure or individual coaching. Any compensated project or deliverable requires a separate written agreement.

D4. Code of Conduct and conflicts

Crew members must comply with the Crew Code of Conduct, disclose relevant sponsor and apparel conflicts, represent AP Racing accurately and respectfully, protect confidential information, and avoid promises on AP Racing’s behalf. AP Racing may suspend or remove a member for material breach, unsafe conduct, misrepresentation, undisclosed conflicts or conduct reasonably likely to harm the community or partners.

Program Schedule E — Camps

This Schedule applies to AP Racing-operated flagship camps, regional camps and AP Racing-branded partner camps unless the event listing or signed event addendum states otherwise.

E1. Event listing controls

The final event listing identifies the event name, dates, location, price, capacity, lodging options, payment schedule, included services and exclusions. If the event listing conflicts with these general Terms on a specific commercial detail, the event listing controls for that detail. The Participant Agreement and Release always applies.

PROGRAM SCHEDULE E

EXPERIENCES & CAMPS TERMS

This Schedule applies to AP Racing-operated flagship camps, regional camps and AP Racing-branded partner camps unless the event listing or signed event addendum states otherwise.

E1. Naming

Camps, Experiences, and any other events that AP Racing promotes, manages, is affiliated with or puts on can be named interchangeably all under the designation experiences.

E1. Event listing controls

The final event listing identifies the event name, dates, location, price, capacity, lodging options, payment schedule, included services and exclusions. If the event listing conflicts with these general Terms on a specific commercial detail, the event listing controls for that detail. The Participant Agreement and Release always applies.

E2. Merchant of record and partners

AP Racing is the merchant of record for AP Racing-branded camp registrations, including partner camps, unless the checkout page expressly identifies another merchant. AP Racing may pay and use regional clubs, ASL Experiences, venues, coaches, lodging providers, transportation providers, food providers, mechanics and other partners to deliver portions of a camp. Those providers may require additional terms or waivers.

E3. Included and excluded services

Only items specifically listed as included are part of the purchase. Unless the listing says otherwise, airfare, travel to and from the destination, bike shipping, equipment, personal expenses, alcohol, medical expenses, travel insurance, extra hotel nights, race entry and airport transportation outside published windows are excluded. The term “all-inclusive” will not expand the written inclusion list.

E4. Itinerary and conditions

Camp schedules are intentionally flexible and may change based on weather, road conditions, venue access, participant needs, safety, staffing, public-health conditions or events outside AP Racing’s control. A reasonable route, session, coach, venue, lodging or schedule change does not constitute cancellation and does not create an automatic refund.

E5. Fitness, equipment and conduct

Participants must arrive with the fitness, technical ability, equipment, insurance and preparation reasonably required by the event listing. AP Racing may modify a participant’s activity, require alternate transportation, restrict participation or remove a participant when safety, readiness, equipment, conduct or group welfare requires it. Additional costs caused by a participant’s condition, conduct, equipment or early departure are the participant’s responsibility.

E6. Member Adventures and shared-expense trips

An informal member trip or ‘Daniel’s Adventure’ with a coordination fee and shared participant expenses is materially different from a supported camp. It must use a separate event-specific addendum describing the coordination fee, estimated and final shared expenses, lodging choices, transportation, support limitations, cancellation deadline and responsibility for committed shared costs. Do not rely solely on this Camp Schedule for those trips.


PART II — PRIVACY POLICY

How AP Racing collects, uses, discloses and protects personal information

PRIVACY CONTACT

Privacy questions and requests may be sent to andy@andypottsracing.com or mailed to Andy Potts Racing, LLC at [INSERT AP RACING MAILING ADDRESS]. This Privacy Policy should be linked from every form, checkout and footer.

1. Scope

This Privacy Policy applies to personal information collected through AP Racing websites, stores, forms, applications, memberships, coaching services, TrainingPeaks workflows, camps, regional hubs, email and text communications, customer support, surveys and in-person activities. It does not control the independent privacy practices of third parties whose services you choose to use.

2. Information we collect

Identity and contact information, including name, preferred name, email, phone number, mailing address, date of birth and emergency contact.

Transaction information, including products purchased, amounts, dates, discounts, refunds, subscription status and limited payment-related records. Full card numbers are generally handled by payment processors rather than AP Racing.

Membership and community information, including location, optional regional affiliation, team status, apparel sizing, partner conflicts, race calendar, participation and communication preferences.

Coaching and performance information, including TrainingPeaks account information, goals, schedules, training history, workouts, performance metrics, equipment access, injuries, health limitations and coach communications.

Camp and travel information, including itinerary, lodging and roommate preferences, dietary needs, transportation needs, emergency information, medical limitations and insurance acknowledgments.

Website and device information, including IP address, browser, device identifiers, pages viewed, referral source, cookie data, analytics and interactions with marketing messages.

Content you submit, including applications, survey answers, messages, photos, testimonials and other materials.

3. How we collect information

We collect information directly from you; automatically through websites, cookies and communications; from coaches, regional hubs and event partners serving you; from TrainingPeaks and other services you authorize; and from payment, registration, travel and technology providers. We may also receive publicly available information relevant to Crew applications, partnerships or athlete profiles.

4. How we use information

Process purchases, subscriptions, payments, renewals, cancellations, refunds and account requests.

Deliver coaching, training plans, memberships, camps, benefits and customer support.

Assign coaches, coordinate regional hubs, group athletes, plan safe sessions and respond to emergencies.

Communicate operational information, training guidance, renewals, program updates, opportunities and marketing where permitted.

Personalize services, evaluate participation, improve programs, maintain records and protect AP Racing, participants and partners.

Comply with law, enforce agreements, investigate misuse and establish or defend legal claims.

5. Sensitive health and training information

Health limitations, injuries, medications, emergency information, precise performance information and similar data may be sensitive. AP Racing collects this information only when reasonably relevant to coaching, safety, accommodation or emergency response. Do not send medical records AP Racing has not requested. AP Racing is not a healthcare provider and its ordinary coaching records are generally not protected by HIPAA.

Where consent is required, you authorize AP Racing to use and disclose the minimum reasonably necessary sensitive information to assigned coaches, event safety personnel, emergency responders, relevant venues and providers, or regional partners directly serving you.

6. How we disclose information

Coaches, staff and contractors who need information to deliver the selected service.

Payment processors, Squarespace, TrainingPeaks, email and communication providers, form providers, analytics providers and other technology vendors.

Regional hubs and club partners, limited to information reasonably needed for local communication, participation and support. National AP Racing retains the primary customer relationship unless disclosed otherwise.

Camp and travel partners, including coaches, ASL Experiences, lodging providers, transportation providers, venues, food providers and emergency personnel, limited to what is reasonably needed.

Professional advisers, insurers, regulators, law enforcement and parties to a business transaction when legally permitted or required.

Other persons at your direction or with your consent.

7. Sale, targeted advertising and analytics

AP Racing does not sell personal information for money. AP Racing may use cookies, analytics or advertising technologies that could be treated as ‘sale,’ ‘sharing’ or targeted advertising under some state privacy laws. Before publication, AP Racing must confirm which technologies are active and provide legally required notices and opt-out mechanisms, including recognition of applicable universal opt-out signals where required.

8. Cookies and website choices

AP Racing and its service providers may use necessary cookies for security, accounts and checkout; functional cookies for preferences; analytics cookies to understand website use; and advertising cookies if enabled. Visitors may use AP Racing’s cookie controls and browser settings. Blocking cookies may affect account, checkout or website functionality.

9. Marketing communications

You may unsubscribe from promotional email using the link in the message. Operational messages about an active purchase, coaching relationship, safety, renewal, billing or event may continue even after marketing opt-out. Text messages will be sent only with the consent required by applicable law, and message and data rates may apply.

10. Retention

AP Racing retains information for as long as reasonably needed to provide Services, maintain business and tax records, administer recurring relationships, preserve coaching and safety history, resolve disputes, enforce agreements and comply with law. Retention periods vary by information type. AP Racing will delete or de-identify information when it is no longer reasonably needed, subject to legal, safety, backup and recordkeeping requirements.

11. Security

AP Racing uses reasonable administrative, technical and organizational safeguards appropriate to the nature of the information. No system, email, cloud platform or transmission method is completely secure. You are responsible for using strong credentials and avoiding ordinary email for unrequested medical records or other highly sensitive documents.

12. Your privacy rights

Depending on where you live and whether a particular law applies to AP Racing, you may have rights to know whether AP Racing processes your personal data; access, correct, delete or obtain a portable copy; opt out of sale, targeted advertising or certain profiling; withdraw consent; or appeal a denied request. AP Racing may verify identity and retain information when an exception applies.

Submit a request to andy@andypottsracing.com with the subject ‘Privacy Request.’ AP Racing will respond within the time required by applicable law. Authorized agents may be required to provide proof of authority. AP Racing will not discriminate against you for exercising an applicable privacy right.

13. Children and minors

AP Racing’s general website and adult programs are not directed to children under thirteen. If AP Racing knowingly offers a youth program or permits a minor participant, AP Racing will obtain information and consent through a parent or legal guardian and use separate program documentation. A parent or guardian who believes a child submitted information without permission should contact AP Racing.

14. International travel and participants

International camps or partner experiences may require AP Racing to transfer information to providers or authorities outside the United States, where privacy protections may differ. AP Racing will limit disclosures to information reasonably needed for registration, lodging, transportation, safety, emergency response and delivery.

15. Program-specific privacy practices

PH+ Coaching. AP Racing uses intake, TrainingPeaks, schedule, goals, performance and coach-communication information to prepare two-month blocks, consultations and adjustments.

1:1 Coaching. AP Racing uses ongoing workout, recovery, schedule, race, travel, performance and communication information to personalize and adapt coaching. Assigned and substitute coaches may access the athlete record when needed for delivery.

Squad. AP Racing uses member contact, location, optional region, apparel size, participation and benefit-use information for national communications, benefits, local opportunities and community administration.

Crew. AP Racing additionally uses application, race calendar, public-profile, sponsor-conflict, conduct and activation information to evaluate eligibility and manage representation.

Camps. AP Racing uses registration, lodging, transportation, ability, dietary, medical limitation, emergency contact and itinerary information to operate the event and may disclose the minimum necessary information to relevant partners and providers.

16. Changes and contact

AP Racing may update this Privacy Policy to reflect service, technology or legal changes. The updated date will appear at the top. Material changes will be communicated when required. Contact AP Racing at andy@andypottsracing.com or [INSERT AP RACING MAILING ADDRESS].


PART III — CANCELLATION AND REFUND POLICY

Program-specific cancellation, renewal, credit, transfer and refund rules

CANCELLATION METHOD

Cancel recurring products through [INSERT AND TEST ONE-STEP ONLINE CANCELLATION URL] or by emailing andy@andypottsracing.com. Keep the confirmation. A cancellation stops future renewals but generally does not refund an active paid period.

1. General rules

A cancellation is effective when submitted through the designated online mechanism or received at the published email address, subject to any initial commitment or notice period stated below.

AP Racing will provide a cancellation confirmation. The customer should retain it.

Refunds are returned to the original payment method when reasonably possible and may take the processor’s ordinary processing time.

No prorated refund is provided for unused access, athlete inactivity, travel, schedule changes, illness or failure to complete intake except where this Policy or applicable law expressly provides otherwise.

AP Racing may waive or modify a policy in a signed writing. A one-time exception does not change the policy for other customers or future transactions.

Nothing in this Policy limits nonwaivable rights under applicable law.

PH+ Coaching

PH+ is billed $299 every two months and renews on the 1st of the month closest proximity date to athlete’s two-month enrollment anniversary until canceled.

Cancel before the next renewal to prevent the next $299 charge. Service continues through the paid cycle.

Minimum 6 month commitment and AP Racing has the right to collect payment via their payment system or invoice for any remaining payments if you cancel early.

A cycle payment is nonrefundable once the coach begins reviewing the athlete’s information, preparing the block or delivering services.

Unused consultations, unanswered outreach, athlete inactivity and unused plan days do not create a refund or rollover.

If a payment was processed after a timely documented cancellation, AP Racing will correct the charge.

If AP Racing cannot provide a material part of the purchased cycle and cannot offer a reasonable substitute, AP Racing will provide an appropriate prorated refund or account credit.

1:1 Coaching

1:1 Coaching costs $299-$1599 per month and has an initial six-month commitment and will be billed on the 1st of every month after the initial payment.

Enrollment requires an initial six-month commitment, which may be collected as a single payment for any remaining balances if the athlete cancels prior to the initial six-month commitment ending,

After the initial term, continuing coaching renews monthly at $299 on the 1st of the month closest to the enrollment anniversary date until canceled with thirty days’ written notice.

Any authorized remaining payments or outstanding balances for the initial six-month commitment remain due once coaching begins, even if the athlete stops participating, except where applicable law or a written AP Racing exception requires otherwise.

After the initial three-month term, coaching continues monthly until canceled with thirty days’ written notice.

Monthly payments are nonrefundable once the coaching month begins. No prorated refund is provided for unused communication, missed workouts, illness, travel or inactivity.

AP Racing may reassign the coach when reasonably necessary. Coach reassignment alone does not create an automatic refund if comparable service continues.

If AP Racing cannot provide coaching and cannot provide a reasonable substitute, AP Racing will offer a prorated refund or credit for the undelivered period.

Squad Membership

Squad costs $199 per year and renews annually on the member’s enrollment anniversary or October 1st of the calendar year, until canceled.

Cancel at any time before the anniversary renewal to prevent the next annual charge. Membership remains active through the paid term.

Annual fees are nonrefundable after membership access or benefits are activated, except for duplicate charges, billing errors, required legal remedies or a written AP Racing exception.

Gear credits, discounts and partner benefits have no cash value and are not separately refundable. If a refund is granted after a member used a monetary benefit, AP Racing may deduct the documented value to the extent permitted by law and disclosed at enrollment.

AP Racing will send annual renewal notice within the period required by applicable law and will include an easy cancellation method.

Crew Membership

Crew costs $199 per year, begins after acceptance and enrollment, and renews annually on the member’s enrollment anniversary or October 1st of the calendar year, until canceled or AP Racing declines renewal.

Cancel before the anniversary renewal to prevent the next annual charge. Crew access ordinarily remains active through the paid term unless terminated for cause.

Annual fees are nonrefundable after Crew access, benefits or onboarding are activated, except for duplicate charges, billing errors, required legal remedies or a written AP Racing exception.

Removal for a material Code of Conduct breach, unsafe behavior, misrepresentation or undisclosed partner conflict does not ordinarily create a refund, to the extent permitted by law.

If AP Racing decides not to renew a member’s Crew eligibility after an automatic charge has already processed, AP Racing will reverse or refund that renewal charge.

AP Racing will send annual renewal notice within the period required by applicable law and will include an easy cancellation method.

Camps

The following schedule is based on the existing AP Racing camp policy. Event-specific listings may offer more favorable terms but may not silently impose less favorable terms after purchase.

Camp cancellation details

The cancellation date is the date AP Racing receives written notice.

Eligible camp fees exclude nonrefundable payment-processor fees when legally permitted and disclosed, previously delivered merchandise, and third-party costs AP Racing has irrevocably committed specifically for that participant, if the event listing clearly discloses those deductions.

Before publication, AP Racing must select and disclose the expiration period, permitted events and transferability of camp credits. Recommended operational default: credit expires twelve months after cancellation, is limited to one transfer, is not redeemable for cash and may be applied only to an AP Racing event with available capacity.

Participant substitutions are permitted only if the event listing allows them and AP Racing approves the substitute’s ability, forms, lodging, partner requirements and timing.

Travel insurance is strongly recommended. AP Racing does not reimburse airfare, bike shipping, extra lodging, visas, insurance, lost wages or other third-party travel expenses.

If AP Racing cancels or materially cannot deliver a camp

If AP Racing cancels the entire camp and does not provide a reasonable rescheduled or substitute experience, registrants may choose a refund of eligible camp fees paid or a full AP Racing account credit. AP Racing is not responsible for airfare, transportation, travel insurance, equipment shipping, third-party lodging or other external costs. Weather-related itinerary changes, reasonable venue substitutions and safety modifications do not constitute cancellation.

Force majeure

If a camp cannot proceed as planned because of severe weather, wildfire, natural disaster, epidemic, government action, war, civil unrest, transportation disruption, venue closure, labor interruption or another event beyond AP Racing’s reasonable control, AP Racing may modify, postpone or cancel the event. AP Racing will provide the refund or credit, if any, stated in the event listing and required by law after accounting for recoverable and nonrecoverable event costs. Counsel should review this provision for each destination and partner contract.

Daniel’s Adventures and shared expenses

Member-only shared-expense trips require a separate event-specific agreement. That agreement should state the coordination or coaching fee, estimated expenses, the date of the final cost estimate, the participant’s right to withdraw before commitment, and the participant’s responsibility for a committed share after finalization. The general camp refund table should not be applied automatically to shared-expense trips.

PART IV — PARTICIPANT AGREEMENT, ASSUMPTION OF RISK AND RELEASE

A broad activity-specific release for training, membership activities and camps

PLEASE READ CAREFULLY — THIS AFFECTS LEGAL RIGHTS

By accepting this agreement, the participant assumes known and unknown risks and releases claims arising from the ordinary negligence of the Released Parties to the fullest extent permitted by law. It is not possible to waive every form of liability. This agreement does not release willful and wanton misconduct, gross negligence where nonwaivable, intentional harm or any liability that applicable law prohibits from being waived.

1. Participant and Released Parties

“Participant” means the individual receiving coaching, using a training plan, attending a membership activity or participating in a camp, clinic, trip or experience. “Released Parties” means Andy Potts Racing, LLC; its owners, officers, members, employees, coaches, contractors, volunteers and agents; regional hubs; event and experience partners; sponsors; landowners; venue operators; lodging and transportation providers; route and facility owners; equipment and service providers; and each of their respective owners, officers, employees, contractors, agents, insurers, successors and assigns, but only to the extent permitted by law and related to the AP Racing activity.

2. Voluntary participation and physical demands

I voluntarily choose to participate. I understand that endurance training and related travel can be strenuous and may involve swimming, open water, pools, cycling, running, trail use, strength work, traffic, vehicles, group activity, remote areas, altitude, heat, cold, weather, fatigue and rapidly changing conditions. I may decline or stop any activity, and I remain responsible for deciding whether participation is appropriate at any moment.

3. Medical fitness and disclosure

I represent that I am physically and medically able to participate or have consulted a qualified healthcare professional as appropriate. I will disclose material limitations requested by AP Racing, carry necessary medications and stop if I experience concerning symptoms. I understand AP Racing is not providing medical clearance and cannot identify every condition or risk.

4. General risks

I understand that risks include, without limitation, slips, falls, collisions, drowning, near-drowning, traffic incidents, driver error, road hazards, potholes, gravel, debris, wildlife, dogs, other participants, equipment failure, bicycle crashes, mechanical problems, trail hazards, altitude illness, dehydration, heat illness, hypothermia, overexertion, cardiac events, musculoskeletal injury, head injury, illness, infection, food reaction, lodging hazards, transportation incidents, crime, delayed emergency response, remote rescue, acts of third parties, and death.

These risks may arise from my actions, another participant, a coach, a contractor, a partner, a venue, a driver, defective or improperly used equipment, route selection, weather, the environment, inadequate preparation, inaccurate information, or the ordinary negligence of one or more Released Parties.

5. Remote coaching and training-plan risks

For PH+, 1:1 Coaching and training plans, I understand that AP Racing may not observe me in person, inspect my route or equipment, know my current medical condition, or receive complete and immediate data. Workouts are recommendations, not commands. I must adjust or stop based on health, fatigue, weather, traffic, terrain, equipment, local rules and real-time conditions. Data, zones, device readings and platform information may be incomplete or inaccurate.

6. Squad and Crew activity risks

Squad and Crew connections, meetups, group workouts, races, challenges and informal activities may be participant-led and may not be supervised by AP Racing. Membership does not mean AP Racing has inspected the route, leader, participant, venue or conditions. I am responsible for independently evaluating and accepting the activity. I understand other members are not necessarily AP Racing employees, agents or qualified coaches.

7. Camp and travel risks

Camps and experiences may involve open roads, group riding, fast or technical descents, long climbs, high mileage, open-water or pool swimming, trail running, strength work, altitude, unfamiliar terrain, vehicles, shared lodging, meals, travel, equipment transport and remote locations. SAG, mechanical, medical, lifeguard or transportation support may be limited or unavailable unless specifically listed. Delays, route changes and separation from the group may occur.

I accept risks associated with independent travel to and from the event; airlines; rental vehicles; drivers; lodging; food; alcohol; theft; lost or damaged equipment; borders and visas; communicable illness; political conditions; and third-party providers. I understand AP Racing cannot guarantee road closures, traffic control, uninterrupted support, emergency-response time, weather, air quality, venue conditions or the conduct of others.

8. Assumption of all risks

I knowingly and voluntarily assume all known and unknown risks of participation, including risks described above, risks that are obvious, risks that are not foreseeable, and risks arising from the ordinary negligence of a Released Party, to the fullest extent permitted by law. I accept full responsibility for my participation, decisions, conduct, equipment and personal property.

9. Release and waiver of claims, including ordinary negligence

TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, WAIVE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ALL CLAIMS, DEMANDS, DAMAGES, ACTIONS OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO MY PARTICIPATION, INCLUDING PERSONAL INJURY, ILLNESS, DISABILITY, DEATH, PROPERTY DAMAGE, ECONOMIC LOSS, PREMISES LIABILITY AND CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

THIS RELEASE EXPRESSLY INCLUDES, TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMS INVOLVING NEGLIGENT INSTRUCTION, COACHING, PROGRAMMING, SUPERVISION, HIRING, RETENTION, ROUTE OR VENUE SELECTION, EQUIPMENT OBSERVATION, TRANSPORTATION COORDINATION, COMMUNICATION, EMERGENCY RESPONSE, FOOD OR LODGING COORDINATION, FAILURE TO WARN, AND THE ACTS OR OMISSIONS OF PARTICIPANTS, CONTRACTORS, PARTNERS OR PROVIDERS.

This release does not apply to willful and wanton misconduct, intentional harm, gross negligence where it cannot lawfully be released, or any other claim that applicable law prohibits from being waived.

10. Covenant not to sue

To the fullest extent permitted by law, I agree not to bring or maintain a claim against a Released Party that I have released in this Agreement. This covenant does not prevent a claim that applicable law does not permit me to release.

11. Indemnification for participant conduct

To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from third-party claims and reasonable costs arising from my intentional misconduct, violation of law or event rules, material misrepresentation, unauthorized use of another person’s property, or injury or property damage I cause. I am not agreeing to indemnify a Released Party for liability that applicable law does not permit to be shifted to me.

12. Medical care and emergency transportation

If I am unable to consent during an emergency, I authorize AP Racing and its representatives to contact emergency services and share relevant information with responders. I understand AP Racing has no duty to provide medical care and may not have trained medical personnel present. I am responsible for medical, evacuation, ambulance, rescue, travel and related expenses not covered by insurance.

13. Insurance and personal property

I am responsible for health, accident, bicycle, vehicle, property and travel insurance appropriate to my participation. AP Racing does not insure my equipment, baggage, vehicle or personal property and is not responsible for ordinary loss, theft or damage except to the extent caused by liability that cannot lawfully be disclaimed.

14. Rules, instructions and removal

I will follow applicable laws, venue rules and reasonable safety instructions. AP Racing may modify or end my participation when it reasonably believes my health, ability, equipment, conduct or circumstances create a risk. I remain responsible for costs associated with alternate transportation, medical care, equipment repair, lodging changes or early departure caused by my condition, decisions or conduct.

15. Electronic acceptance; opportunity to review

I understand this Agreement is contractual, not merely a recital. I have had the opportunity to read it, ask questions and seek independent advice. My electronic signature, required checkbox or signed registration has the same effect as a handwritten signature. I will receive or may retain a copy.

16. Colorado law; severability; survival

Colorado law governs this Agreement. If any provision is held unenforceable, it will be narrowed or severed to the minimum extent necessary, and the remainder will continue. The assumption of risk, release, covenant not to sue, indemnification, limitation and dispute provisions survive the end of participation.

Participant acceptance

I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD THIS PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING CERTAIN RIGHTS TO SUE FOR ORDINARY NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY LAW. I ACCEPT IT VOLUNTARILY.
